Terms of Service

Effective date: October 12, 2026Last updated: October 12, 2026

Clear terms for remote data services, project scope, payment, digital delivery, cancellations, and ongoing work.

01

About these terms

These Terms of Service govern the use of the Loxmere Analytics website and the remote data services we agree to provide. In these terms, “Loxmere Analytics,” “we,” “us,” and “our” refer to the business operating this website. “Client,” “you,” and “your” refer to the person or organization requesting a service. The business was established on October 8, 2026. These terms take effect on October 12, 2026.

By using the website or accepting a written project proposal, you agree to the terms relevant to that activity. A project starts only when its scope, price, and other essential details have been agreed. An enquiry alone does not create an obligation to purchase services. If a signed agreement or written statement of work contains a different provision for a particular project, that provision takes priority for that project. Mandatory consumer rights remain unaffected.

02

Who can use our services

Our services are available to individuals, independent professionals, and small businesses. You must be at least 18 years old, or otherwise have legal capacity to enter into the relevant agreement. If you request work for an organization, you confirm that you have authority to act for that organization and to provide the information needed for the project.

You agree to provide accurate contact and billing information and to keep important project instructions up to date. We may ask for reasonable clarification of the client’s identity, authority, or intended use of the work where necessary to protect confidential data or to comply with applicable law. We may decline an enquiry that is outside our service scope or that would require unlawful processing of information.

03

Services and deliverables

Loxmere Analytics provides remote data cleaning and formatting, Excel spreadsheet analysis, custom data reports, sales data analysis, customer data analysis, data visualization and charts, business performance dashboards, and monthly data reporting and analytics. The work is based on information supplied or authorized by the client. Services are delivered digitally; in-person meetings and physical goods are not part of the standard offering.

The statement of work identifies the files to be reviewed, relevant questions, expected outputs, delivery format, and any agreed revisions. Possible outputs include cleaned spreadsheets, calculations, written summaries, charts, and digital dashboards. A service name describes its general purpose and does not automatically include every possible feature, unlimited data volume, software integration, live data connections, or ongoing maintenance. Additional functionality must be agreed in writing.

04

Quotes, starting prices, and payments

Prices shown on the website are starting prices in U.S. dollars. Data volume, file condition, project complexity, number of sources, reporting requirements, and the requested format may affect the final fee. We confirm the price and scope before work begins. A quote is valid for the period stated in the quote; if no period is stated, availability and pricing should be reconfirmed before acceptance.

Payment timing, any deposit, and accepted payment methods are specified in the project agreement or invoice. Taxes or other legally required charges, where applicable, are identified before payment is requested. We do not ask clients to place passwords, bank login credentials, or full payment-card details in a general enquiry. If an invoice is overdue, we may pause further work after reasonable notice. Any resulting schedule change will be discussed with the client.

05

Monthly services and renewals

Monthly Data Reporting & Analytics is offered from $300 per month for the agreed recurring scope. The agreement should identify the reporting period, client data deadlines, outputs, payment schedule, and any minimum commitment. A monthly price by itself does not establish automatic renewal, authorize a recurring charge, or create an unlimited service subscription. Any renewal or recurring billing arrangement must be expressly agreed.

For an ongoing engagement without a specified minimum term or different cancellation requirement, you may request cancellation before the next reporting period begins. Work already performed and agreed commitments for the current period remain payable. If a cancellation request arrives after a new period has started, we will discuss the work completed, any remaining work, and any appropriate adjustment before confirming the account’s closing position.

06

Client information and lawful access

You are responsible for supplying complete, accurate, and usable files and for ensuring you have the right to share and use the data. This includes obtaining permissions or other lawful authority for customer, employee, or third-party information contained in a dataset. Share only information reasonably necessary for the agreed project. Where possible, remove unnecessary identifiers or use anonymized records.

Do not provide unlawfully obtained data, account credentials, identity documents, or highly sensitive personal information through an ordinary enquiry. Projects involving regulated or particularly sensitive data require a separate discussion of the intended processing and appropriate safeguards before files are exchanged. Keep a backup of your original materials. If the source files contain errors or important information is missing, we may need to clarify the issue or adjust the project plan.

07

Timing, delivery, and client review

Delivery dates are agreed for each project after the scope and condition of the data are understood. The schedule depends on timely receipt of the agreed files, instructions, approvals, and payments. We will communicate material delays that affect the agreed timetable and discuss reasonable next steps. A requested date is not confirmed until it is accepted in the project agreement.

Deliverables are provided through an agreed digital channel and in the agreed format. Please review the work promptly and identify specific issues against the accepted scope. Unless a different review period is agreed, tell us about a material scope-related issue within 14 calendar days of delivery. This review period does not remove any rights that cannot lawfully be limited. Correcting an error in the agreed work is distinct from requesting a new dataset, different analysis, additional features, or a redesigned deliverable.

08

Revisions and changes to scope

The project agreement sets out any included revisions. A revision normally means a reasonable adjustment within the agreed question, source data, and deliverable format. New reporting periods, replacement source files, additional business questions, new integrations, and changes to the fundamental project objective may require a revised quote.

We will describe the proposed additional work and its effect on price and timing before proceeding. Neither party should assume that an informal discussion automatically changes the accepted scope. If there is disagreement about a requested change, we may pause the affected part of the work while the details are clarified. Previously approved work remains subject to the original agreement.

09

Cancellations, refunds, and service concerns

You may request cancellation using the contact details at the end of these terms. If work has not started and no non-recoverable costs have been committed with your authorization, payments for the cancelled work will be refunded. Once work has begun, the amount retained should reflect work reasonably completed and any specifically authorized, non-recoverable costs. We will explain the calculation rather than applying an undisclosed blanket cancellation charge.

If we cannot complete an agreed service, we will discuss an appropriate remedy, which may include revised delivery, a replacement service agreed by you, or a refund for the undelivered part. If a delivered output materially fails to meet the agreed scope, contact us with the relevant details so we can review and, where appropriate, correct the work or offer a proportionate remedy. Refund handling follows the original payment method where practicable. Statutory withdrawal, cancellation, refund, and other consumer rights take precedence where they apply.

10

Ownership and permitted use

You retain ownership of the data and materials you provide. You grant us the limited permission needed to access, organize, analyze, and use those materials to perform the agreed service. We do not acquire a general right to publish your files or use identifiable client datasets as marketing material.

After the agreed fees have been paid, you may use the final deliverables for your personal or internal business purposes and for any broader use expressly agreed in the statement of work. We retain ownership of pre-existing templates, general methods, tools, reusable structures, and know-how developed independently of your confidential data. Where these are incorporated into a deliverable, you receive the permission needed to use that deliverable as intended. Third-party software and materials remain subject to their own licenses.

11

Confidentiality and project data

Both parties should treat non-public project information as confidential and use it only for the engagement or another expressly authorized purpose. Information may be shared with service providers or authorized personnel only to the extent reasonably needed for delivery, administration, security, or legal obligations, and subject to appropriate confidentiality arrangements.

Confidentiality does not cover information that is already lawfully public, independently developed without using the other party’s confidential information, or lawfully received from another source without restriction. If disclosure is legally required, we will provide notice where permitted and reasonably practicable. Retention and handling of personal information are described in the Privacy Policy and may be further specified in a project-specific data processing agreement.

12

Analytical limits and decisions

Our reports explain findings supported by the available data and the assumptions used for the agreed analysis. Incomplete records, inconsistent definitions, limited time periods, or changes in data quality can affect results. An analysis of historical information does not guarantee future sales, profit, customer behavior, savings, or other outcomes.

You remain responsible for business and personal decisions made using the deliverables. Our standard data services are not an audit, regulated accounting service, legal opinion, tax advice, investment recommendation, or independent certification of source records. If you need a regulated professional opinion, obtain advice from an appropriately qualified professional. We will not knowingly present missing information as established fact or agree to fabricate analytical results.

13

Website use and intellectual property

You may use the website to learn about services and make legitimate enquiries. Do not attempt to disrupt the website, gain unauthorized access, upload malicious material, impersonate another person, or use the site to infringe privacy or intellectual property rights. Website copy, design, branding, and other original materials are protected by applicable intellectual property law.

Information on the website may be updated to improve clarity or reflect changes in services. We aim to present service information accurately, but an individual project agreement is the authoritative description of the work purchased. Displayed photographs illustrate the visual identity of the website and do not by themselves establish the location of the company, identity of staff, or identity of clients.

14

Liability, circumstances beyond control, and disputes

Each party is responsible for its own obligations under the agreed engagement and applicable law. To the extent legally permitted, neither party is liable for indirect or consequential losses that were not reasonably foreseeable when the agreement was made. Where a contractual limit is enforceable, our aggregate liability for a particular project will not exceed the fees paid or payable for that project. These limits do not exclude liability for fraud, willful misconduct, or any liability that applicable law does not permit to be excluded or limited.

Neither party is responsible for a delay caused by an event reasonably beyond its control, provided it takes reasonable steps to reduce the effect and communicates material disruption. If a concern arises, contact us first so we can try to resolve it fairly. The laws of Kentucky govern the agreement, except where mandatory law gives a consumer the protection of another jurisdiction. Nothing here prevents a client from using a court, regulator, or other remedy available under mandatory law.

15

Changes and contact

We may revise these terms as the website or service offering develops. The last-updated date identifies the current version. A revision does not retroactively change a previously accepted project agreement unless both parties agree or applicable law requires the change. Material changes to an ongoing engagement should be communicated before taking effect.

For questions about a quote, cancellation, deliverable, invoice, or these terms, use the contact details below. Include enough information to identify the relevant project and explain the issue. We will consider the request in the context of the agreed scope and the rights that apply.
